Wynn Las Vegas Sued in Wrongful Death of Lawyer

The family of a renowned Florida attorney, who succumbed to an unfortunate cardiac arrest while gambling blackjack at Wynn Las Vegas, is taking legal action against the casino for its disregard of safety.

David Jagolinzer, of the Ferraro Law firm, a law firm based in Miami, suffered a cardiac arrest in the early morning hours of April 6, 2021 at Wynn Las Vegas.

According to the family’s wrongful death lawsuit, Jagolinzer was playing blackjack for roughly two hours when he began to feel unwell and asked for assistance from casino staff. Despite his pleas for help, no medical attention was given by the casino staff or any employee onsite.

At 48, Jagolinzer tragically passed away from anoxic encephalopathy as a result of the heart attack. This condition can be prevented if medical treatment is given promptly, but sadly that wasn’t the case for him. Thus, his family sought justice and brought forward a lawsuit to address this issue.

The family’s lawsuit accuses the casino of negligence, claiming that Wynn Las Vegas failed to adhere to safety regulations, such as providing medical help promptly and preventing Jagolinzer from playing for an extended period without proper rest.

The lawsuit also alleges that Wynn Las Vegas was aware of the potential danger of allowing customers to gamble for extended periods without proper rest, but did not take any measures to prevent this or provide medical attention when asked.

The suit seeks compensatory and punitive damages, as well as an injunction against the casino to ensure that it follows safety protocols in the future.

The family also requests that Wynn Las Vegas be held accountable for the wrongful death of Jagolinzer.

The case is still pending in court and no official rulings have been issued at this time.
