What Is a Wrongful Death Claim?

Wrongful death claims exist to protect the rights and well-being of a victim’s family.

A wrongful death claim can be filed when the death of a person was caused directly by the negligence of another—for example, in a car accident, medical malpractice, or a situation involving premises liability.

In all wrongful death cases, the claimant must be able to prove negligence beyond a reasonable doubt. This is not always easy, but the experienced wrongful death attorneys at Shook & Stone have more than 85 years of combined experience in these cases.

How to File a Wrongful Death Claim in Nevada

According to Nevada law, heirs and personal representatives of the deceased may pursue legal actions to recover compensation from the party responsible for the victim’s death. If the person responsible for the victim’s death is also deceased, legal actions can be brought against the wrongdoer’s personal representatives, or any other parties involved.

Compensation may be rewarded in the following three categories:

  1. Economic Compensation
Economic compensation includes any medical expenses the victim incurred before their death, funeral expenses, lost wages, and probable future financial support.
  2. Non-Economic Compensation
The court may also grant compensation for the emotional damages that a victim’s relatives and loved ones suffered as a result of their untimely death. While pain and suffering are impossible to put into dollar amounts, monetary damage awards can at least help alleviate the financial strains that a wrongful death can create for surviving relatives.

Non-Economic Damages can be awarded for:

    • Loss of companionship.
    • Loss of society. (This covers the loss of a loved one’s company and guidance.)
    • Loss of comfort.
    • Loss of consortium. (This covers the loss of love, affection, and performance of marital services such as child care and home maintenance.)
    • Grief or sorrow
    • Pain, suffering, or disfigurement of the victim
  3.  Punitive Damages
Punitive damages are intended to further punish the defendant in cases involving gross acts of negligence. They are intended to defer the wrongdoer from repeating the actions that led to the wrongful death. While nothing can fully take away the grief of losing a loved one, the wrongful death lawyers at Shook & Stone understand that justice can help bring some families a sense of closure. Our legal negotiators will work to achieve the highest degree of justice on behalf of every victim’s family.
