The Department of Veterans Affairs Individual Unemployability program is designed to help veterans who are not able to maintain gainful employment due to a service connected disability. Specificially, it allows eligible veterans to receive certain veterans disability compensation at the 100% rate, even if their service connected disabilities are rated at less than 100%.
You may be eligible for Individual Unemployability if:
- You are a veteran
- You have at least one disability (service connected) rated at least at 60%; OR
- You have two or more disabilities (service connected) with at least one disability rated at 40% or more and a combined rating of 70% or more.
- You must be unable to maintain substantially gainful employment due to your service connected disability. The VA does not consider marginal employment – which includes odd jobs – as substantial gainful employment.
