Why USPS Truck Accidents Are Different
While all collisions can vary in severity, an accident with a USPS truck can be especially detrimental. This is due to the size, weight, and cargo of the vehicle.
USPS trucks are also on the road much more than your typical commuter, thus requiring more routine maintenance that can be missed. USPS carriers also make frequent stops, increasing the likelihood of an accident.
A seasoned Las Vegas truck accident lawyer will know these differences and be able to help you use them in building your case.
Injuries Can Be More Severe
As mentioned, USPS vehicles are generally larger than typical commuter cars, which increases the likelihood of an accident being more devastating. Injuries can range from minor inconveniences to severe, life-changing disabilities.
At Shook & Stone, our Las Vegas personal injury lawyers believe that regardless of severity, you deserve compensation for your injuries and will fight to make sure you get it.
Liability Can Belong to Different Parties
Given that USPS is a large organization, liability does not just fall on the driver. USPS trucks must adhere to strict maintenance routines, including daily inspections.
Drivers also must follow specific safety guidelines when operating vehicles. If these are not followed properly, USPS as well as the driver may be liable.
USPS Is a Federal Entity
Since USPS is a federal agency, accidents involving their vehicles are not handled in the typical way. Rather than going through private insurance, claims typically go through the Federal Tort Claims Act (FTCA).
This allows an individual to sue the federal government for damages. This process can be complicated, so having a Las Vegas USPS truck accident attorney can be immensely helpful.
Understanding the Federal Tort Claims Act (FTCA)
The Federal Tort Claims Act (FTCA) is one of the most important aspects of a USPS truck accident claim. Unlike standard motor vehicle accident cases, which often involve filing a claim with an insurance company or a private entity, USPS truck accidents involve suing the federal government. This requires following particular legal procedures.
Under the FTCA, you are required to first file directly with the USPS or the appropriate federal agency before you can bring a lawsuit in federal court. This initial claim must be filed within two years of the date of the accident.
If your claim is denied or the agency fails to respond within six months, then you may proceed to file a lawsuit. At Shook & Stone, we understand how to navigate the unique rules involved in these cases.
Types of Damages You Could Be Entitled To
If you have been injured in an accident involving a USPS truck, it can put a severe financial strain on you and your family, and you deserve to be compensated.
- Medical expenses include emergency room visits, surgeries, physical therapy, and ongoing treatment.
- Lost wages, including time off work, reduced earning capacity, or permanent disability.
- Pain and suffering compensation for the physical pain and emotional distress you have endured.
- Property damage, which can include repairs or replacement of your vehicle and any other damaged belongings.
- Loss of consortium in cases where the accident impacts your relationship with your spouse or family.
Because the damages in USPS truck accident cases can be extensive, it’s critical to evaluate all aspects of your loss, not just the immediate medical bills.
A USPS truck accident attorney in Las Vegas will take the time to understand your full story and work with medical professionals, economists, and accident reconstructionists to build a strong case on your behalf.

Common Causes of USPS Truck Accidents
With USPS trucks operating on tight schedules and frequently navigating congested urban areas, several factors can contribute to an accident:
- Driver fatigue from long shifts and heavy workloads
- Poor vehicle maintenance, such as worn brakes or bald tires
- Distracted driving, including GPS use or scanning delivery information
- Poorly trained or underqualified drivers
- Failure to enforce safety protocols by management
- Dangerous road conditions, construction zones, or unpredictable traffic patterns
Whether the cause of your accident was driver error, mechanical failure, or a systemic issue within USPS, our Las Vegas car accident lawyer has the experience to investigate and hold the responsible parties accountable.
What to Do After a USPS Truck Accident
After an accident with a USPS truck, it’s essential to act quickly to preserve as much evidence as possible.
- Call 911 and report the accident. Get medical help for anyone injured.
- Document everything. Take photos of the vehicles, your injuries, road conditions, and any visible truck identifiers like the USPS logo or license plate.
- Get witness contact information. Bystanders can be key to supporting your claim.
- Do not admit fault or try to speculate about what happened.
- Contact a qualified lawyer before speaking with any representatives from USPS or government agencies.
Even a small mistake can affect your ability to recover compensation. When you work with Shook & Stone, we take the pressure off you and handle all communications and filings so you can focus on healing.
