A Las Vegas UPS Truck Accident Attorney Will Establish Liability in Your Case
Establishing liability in a truck accident case is a must for several reasons. The correct party must be identified so they can make proper restitution.
Because of this, fault must be shown and supported by evidence to solidify it as a fact in the case. To do that, a Las Vegas personal injury lawyer will use the following steps to accomplish this requirement:
- Duty of care: UPS personnel have a duty to use safe practices in their job duties and apply caution when out on the road.
- Breach of duty: If UPS personnel do not uphold these practices and exercise caution, they are in breach of their duty to you.
- Causation: The UPS personnel’s actions contributed to the accident directly or indirectly and caused your injuries.
- Damages: As an at-fault party, UPS must compensate you for the losses it caused.
Once your lawyer has satisfactorily demonstrated each phase, the other party can truly be held accountable, and actions can be taken accordingly. Your case will be centered around this process, and your lawyer will ensure you have a strong case.
Modified Comparative Negligence for Shared Fault Cases
In addition to UPS liability, it is also important to know what happens if you are partially at fault. By understanding modified comparative fault in Nevada (NRS 41.141), you can get the legal help you need to recover maximum damages. Your lawyer will help reduce your liability so your fault is below the 50% threshold, so your damages are minimally reduced and you are not barred from recovery..
Nevada Limits Legal Action to Two Years
The limitation of actions on UPS truck accident cases is 2 years from the time of the accident. Because of the complexity of these cases and the time needed to resolve them, it is important to hire a lawyer right away so there is plenty of time to investigate the accident, build your case, and establish the negligent party’s liability.
UPS Contributes to the Most Delivery Accidents
According to the Federal Motor Carrier Safety Administration (FMCSA) Safety and Fitness Electronic Records (SAFER) System’s company snapshot, UPS has contributed to 2,319 crashes in the last two years.
Among those were 70 fatalities and 793 injuries. When compared to FedEx and Amazon, UPS has the highest number of accidents.
UPS drivers are often under a lot of pressure to maintain tight delivery schedules. These expectations can make it difficult for drivers to keep up and not make errors. It can also contribute to driver exhaustion and increase the risk of an accident.
If these factors contributed to your accident, you may be entitled to take legal action. A UPS truck accident lawyer in Las Vegas knows how the company operates and can effectively fight for you when you have been injured.

Parties Who Can Be Held Liable in a Las Vegas UPS Truck Accident
Since UPS drivers are often on the front lines, they are the ones most likely to be at fault for causing an accident. Distractions, speeding, failing to check their blind spots, and more can result in collisions with other vehicles. These factors are generally the result of negligence and are preventable.
UPS as an entity can be held liable if the accident was a result of its negligence. UPS could be at fault if they do not follow or enforce safety or hours of service regulations. Failing to properly train drivers can also lead to liability for the company.
In addition to these two primary parties, truck mechanics can be at fault if they fail to use appropriate care and contribute to mechanical failure and an accident.
Similarly, manufacturers who issue defective parts can also be liable if an accident occurs. Finally, cargo loaders can be liable if they fail to load and balance trucks correctly.
