Getting hurt on the job can turn your life upside down in an instant. Medical bills pile up, paychecks stop, and suddenly you’re navigating a confusing claims process. Choosing the right Reno workers’ compensation attorney can make a significant difference in whether you receive the full benefits you’re entitled to under Nevada law. Under Nevada Revised Statutes (NRS) Chapter 616, Nevada operates a no-fault workers’ compensation system, meaning injured workers don’t need to prove employer negligence to qualify for benefits. You need someone who understands the system and will fight to protect your rights.

What Does a Workers’ Compensation Attorney Actually Do?
Many injured workers are surprised to learn how much a workers’ comp lawyer does on their behalf. The process begins with case evaluation, where an attorney assesses whether your injury is work-related and whether you’re entitled to compensation. From there, the attorney builds your claim, gathers medical documentation, and prepares for hearings or appeals.
One of the most important roles is negotiating with the insurance company. Insurance adjusters are trained to minimize payouts, and without legal representation, injured workers may be pressured into accepting far less than they deserve. A workers’ compensation attorney levels the playing field by challenging lowball offers and improperly denied claims.
Attorneys also evaluate settlement offers with a critical eye, breaking down medical costs, lost wages, and potential future treatments. This helps injured workers avoid accepting settlements that fail to account for the long-term impact of their injury. Reviewing what a workers’ compensation lawyer does can help set expectations before your first consultation.
Understanding Nevada’s Workers’ Compensation System Before You Hire
Before choosing a Reno NV work injury lawyer, it helps to understand the legal framework they’ll be working within. Nevada requires all private employers with one or more employees to carry workers’ compensation insurance under NRS 616B.612. This no-fault system means you only need to demonstrate that your injury occurred within the scope of your employment.
Workers’ compensation in Nevada covers three primary categories: lost wages through temporary disability payments, medical bills, and permanent disability payments (typically paid in installments by default). In exchange for these benefits, injured workers generally give up the right to sue their employer for negligence.
Because workers’ compensation is an exclusive remedy in Nevada, employers who provide coverage are generally protected from additional damages. However, if a third party, such as a negligent contractor or equipment manufacturer, contributed to your injury, you may have the right to pursue a separate civil claim alongside your workers’ comp benefits.
💡 Pro Tip: Even if you believe your injury was partially your fault, you may still qualify for Nevada workers’ compensation benefits under the no-fault system.
Key Deadlines You Cannot Afford to Miss
One of the most urgent reasons to hire a workers’ comp lawyer in Reno, Nevada is to protect yourself against missing critical deadlines. Under Nevada law, injured workers have only 7 days to provide notice of their injury to their employer and 90 days to file a formal claim. Missing either deadline can jeopardize your ability to recover benefits entirely.
These timelines are statutory and not flexible in most circumstances. Courts interpret exceptions narrowly, so don’t assume extensions will automatically apply.
Nevada also provides certain injured workers with a long-term safeguard: under NRS 616C.390, Nevada allows injured workers to reopen their workers’ compensation claim during their lifetime if they can demonstrate a change in circumstances, supported by physician certification, that warrants increased compensation. However, this lifetime reopening right applies only to workers who were off work as a result of their injury or who received a permanent partial disability award. Workers whose claims didn’t involve lost time must generally apply to reopen within one year of the claim being closed. 💡 Pro Tip: If you’re unsure whether your employer has workers’ compensation insurance, you can verify coverage through the Nevada Division of Industrial Relations.

What Benefits Can You Receive Under Nevada Workers’ Comp?
Understanding what you’re entitled to receive helps you recognize when an insurance company may be shortchanging you. Nevada workers’ compensation benefits generally include:
- Temporary Total Disability (TTD) payments: If your injury prevents you from working, you may receive TTD benefits equal to 66.66% of your average wage, paid bi-weekly, under NRS 616C.475.
- Medical benefits: Your authorized treating physician’s bills are generally covered, including surgeries, prescriptions, and rehabilitative care.
- Permanent Partial Disability (PPD) payments: If your injury results in lasting impairment, you may receive benefits based on a percentage rating of your disability. By default, PPD benefits are paid as monthly installment payments until the worker reaches age 70, though workers may elect to receive all or a portion of their award as a lump sum (reduced to present value) subject to eligibility conditions and disability rating thresholds under NRS 616C.495.
- Vocational rehabilitation: Injured workers who cannot return to their prior occupation may qualify for retraining benefits.
What you receive depends on the specific facts of your injury, the treating physician’s findings, and how aggressively your claim is managed by the insurer.
💡 Pro Tip: Certain conduct at the time of your injury could reduce or eliminate your award under NRS 616C.230. For example, compensation may be denied if your injury was proximately caused by intoxication or willful self-harm.
What to Look for When Choosing a Reno Workers’ Compensation Attorney
A Track Record With Workers’ Comp Claims in Nevada
Not every personal injury attorney handles workers’ compensation cases, and Nevada workers’ comp law involves distinct rules, agencies, and procedures. When evaluating a workers’ comp lawyer in Reno, Nevada, look for someone with a demonstrated history of handling claims under NRS Chapter 616 and 617. Ask whether they’ve handled claim denials, PPD rating disputes, or employer retaliation cases.
Communication and Responsiveness
Your attorney should be someone you can actually reach when you have questions. Ask prospective attorneys how they communicate with clients, how quickly they return calls or emails, and whether you’ll work directly with the attorney or primarily with support staff.
Willingness to Evaluate Your Case Honestly
The right workers’ comp attorney will give you an honest assessment, not just tell you what you want to hear. A thorough initial case evaluation should include discussion of the strengths and weaknesses of your claim, deadlines you need to meet, and the potential range of benefits under Nevada law. Be cautious of anyone who makes guarantees about outcomes.
How Nevada’s Exclusive Remedy Rule Affects Your Legal Options
Understanding the exclusive remedy doctrine is essential before you decide how to pursue your claim. In most cases, when you’re injured at work in Nevada, you cannot sue your employer directly. Workers’ compensation is generally the primary legal avenue available to you.
However, exclusivity has its limits. If your employer doesn’t carry workers’ compensation insurance as required by NRS 616B.612, you may have the right to file a civil lawsuit. Additionally, if a third party contributed to your injury, that claim may exist entirely outside the workers’ compensation system.
A workers’ compensation representation attorney in Nevada can help you evaluate whether both avenues are available to you. These two tracks can sometimes run simultaneously but involve separate legal standards, deadlines, and procedures.
💡 Pro Tip: If your workers’ compensation claim has been resolved but your condition has worsened, Nevada law may allow you to reopen your claim under certain circumstances. To understand your options, consider speaking with a Reno workers’ compensation attorney who can review your situation.
Red Flags to Watch for During Your Search
Not every attorney who handles injury cases will be the right fit for a Nevada workers’ comp claim. Be cautious if an attorney cannot clearly explain how Nevada’s exclusive remedy rule applies to your situation, cannot identify key deadlines under NRS Chapter 616, or seems unfamiliar with the administrative appeals process through the Nevada Department of Administration, Hearings Division.
You should also be alert to anyone who discourages you from asking questions or rushes you through the initial consultation without gathering meaningful facts about your injury.
It also helps to understand the limits of any online research you conduct. While informational resources can help you learn the basics, your specific rights depend on your employer’s insurance status, the nature of your injury, and other facts unique to your case.
