Your Safety Violation Could Cost You Thousands in Workers’ Comp Benefits
You suffered a serious workplace injury, but now you’re facing a harsh reality—your workers’ compensation benefits could be slashed by 30% because of a safety violation. This isn’t just a scare tactic. Nevada law specifically allows insurers to reduce your workers’ compensation award if you violated safety rules when you got hurt. If you were injured while driving on the job without wearing your seatbelt, or failed to use required safety equipment, you could lose thousands of dollars in benefits you desperately need for medical bills and lost wages.
Many injured workers don’t realize that their actions at the time of injury can dramatically impact their compensation. Even though workers’ compensation is supposed to be a no-fault insurance plan that provides guaranteed financial payments for work-related injuries and illnesses, there are important exceptions. Understanding these exceptions and how safety violations affect your claim can mean the difference between getting the full compensation you deserve and struggling with reduced benefits during your recovery. A Workers Compensation Attorney can help you understand these complex rules and protect your rights after a workplace injury.
💡 Pro Tip: Document all safety equipment provided by your employer and any safety training you received. This documentation could be crucial if your employer tries to claim you violated safety rules.

Understanding Nevada Workers’ Compensation and Safety Violation Rules
Under Nevada Workers’ Compensation Law, you have the right to receive benefits for workplace injuries, but these rights come with responsibilities. All employers in Nevada are required to have workers’ compensation insurance, which provides no-fault coverage for work-related injuries. However, NRS 616C.230 provides specific grounds for denial, reduction, or suspension of compensation, including safety violations. This means that while you don’t need to prove your employer was at fault for your injury, your own actions can significantly impact your benefits.
The reality is that workers must follow all laws and company safety rules or risk having their workers’ compensation award reduced by up to 30%. This reduction isn’t automatic—insurers must prove you knowingly violated a safety rule and that this violation contributed to your injury. Common safety violations that lead to benefit reductions include failing to wear required personal protective equipment, not following lockout/tagout procedures, operating machinery without proper authorization, or violating traffic laws while driving for work. A Workers Compensation Attorney can review the specific circumstances of your injury and help determine whether the insurer has valid grounds for reducing your benefits.
Your employer has significant control over your workers’ compensation claim from the start. Unfortunately, you do not get to choose your own doctor when you’ve been injured on the job; your employer chooses the doctor. This can create challenges if you disagree with the doctor’s assessment or treatment plan. Additionally, if your claim is approved, temporary disability payments equal approximately two-thirds of your weekly pay, which means you’re already facing financial pressure even without a benefit reduction. When a Workers Compensation Attorney represents you, they can help ensure you receive fair treatment and challenge any unfair benefit reductions.
💡 Pro Tip: Request a copy of your employer’s safety manual and any safety training records immediately after your injury. These documents can help prove you were following proper procedures.
The Workers’ Comp Claim Process When Safety Violations Are Alleged
When your employer or their insurance company alleges you violated safety rules, the claims process becomes more complex and contentious. Understanding the timeline and what to expect can help you prepare for the challenges ahead. The process typically unfolds over several weeks or months, with critical deadlines that can affect your right to benefits.
- Immediate reporting (0-7 days): Report your injury to your employer immediately and seek medical treatment. Document everything about the accident, including any safety equipment you were using.
- Initial investigation (1-4 weeks): The insurance company will investigate your claim, looking specifically for evidence of safety violations. They may request statements, review security footage, and interview witnesses.
- Benefit determination (2-6 weeks): The insurer will decide whether to accept, deny, or reduce your claim based on alleged safety violations. If they propose a 30% reduction, you’ll receive written notice explaining their reasoning.
- Appeal process (30-90 days): If your benefits are reduced or denied, you have the right to appeal through the Nevada Department of Administration. This involves hearings where a Workers Compensation Attorney can present evidence supporting your claim.
- Final resolution (3-12 months): Complex cases involving safety violations often require multiple hearings and may take months to resolve. During this time, you may receive reduced benefits or no benefits at all.
💡 Pro Tip: Nevada law requires you to act quickly when challenging benefit reductions. Missing appeal deadlines can permanently affect your right to full compensation.

Fighting Back Against Unfair Workers’ Comp Reductions with a Workers Compensation Attorney
When insurance companies try to reduce your workers’ compensation benefits by claiming safety violations, you don’t have to accept their decision without a fight. Many alleged safety violations are exaggerated or taken out of context by insurers looking to save money. Nevada Workers’ Compensation laws require clear evidence that you knowingly violated a specific safety rule and that this violation directly contributed to your injury. A Workers Compensation Attorney from Shook and Stone understands these legal standards and can challenge the insurer’s interpretation of events.
Successfully challenging a benefit reduction requires gathering evidence that supports your version of events. This might include witness statements from coworkers who can testify about normal workplace practices, documentation showing inadequate safety training, evidence that safety equipment was broken or unavailable, or proof that your employer routinely ignored the safety rule in question. Your attorney can also argue that even if a minor safety violation occurred, it didn’t contribute to your injury. For example, if you weren’t wearing safety glasses when a forklift struck you from behind, the lack of eye protection didn’t cause or worsen your injuries.
The attorneys at Shook and Stone have extensive experience defending injured workers against unfair benefit reductions. They understand how insurance companies investigate claims and know what evidence to gather to protect your rights. Having legal representation levels the playing field when you’re facing an insurance company with teams of adjusters and lawyers working to minimize your benefits. Your Workers Compensation Attorney can negotiate with the insurer, represent you at hearings, and ensure you receive the full compensation you deserve for your workplace injury.
💡 Pro Tip: Start documenting your workplace safety culture immediately. Take photos of safety equipment, note any broken or missing gear, and document instances where supervisors overlooked safety rules to meet deadlines.
Common Safety Violations That Trigger Workers’ Comp Reductions in Nevada
Understanding which safety violations most commonly lead to benefit reductions can help you protect yourself both before and after a workplace injury. Insurance companies aggressively investigate certain types of violations because they’re easier to prove and more likely to result in successful benefit reductions. Construction workers, warehouse employees at facilities like Amazon distribution centers, and resort workers on the Las Vegas Strip face particular scrutiny when accidents occur.
High-Risk Violations in Nevada Workplaces
The most common safety violations that result in workers’ comp reductions include failing to use fall protection on construction sites, which is especially significant given that scaffolding violations are the most common OSHA violation. Operating forklifts or heavy machinery without proper certification can devastate your claim, particularly in warehouse settings. Not following lockout/tagout procedures when servicing equipment is another red flag for insurers. Perhaps most importantly, any violation of traffic laws while driving for work, including not wearing seatbelts, speeding, or distracted driving, almost guarantees a benefit reduction. If you work in these high-risk environments, a Workers Compensation Attorney can help you understand your specific risks and rights under Nevada law.
💡 Pro Tip: Keep a personal log of safety concerns you’ve raised with supervisors. Email yourself copies of any safety complaints or suggestions you make—this creates a timestamped record that can protect you later.
When Safety Violations Lead to Complete Denial of Benefits
While a 30% reduction in benefits is devastating, some safety violations can result in complete denial of your workers’ compensation claim. Nevada law allows insurers to deny all benefits in specific circumstances, leaving injured workers with no compensation for medical bills or lost wages. Understanding these complete bars to compensation is crucial for every Nevada worker.
Absolute Bars to Workers’ Compensation Benefits
Under Nevada Workers’ Compensation laws, compensation is not payable for injuries proximately caused by employee intoxication or controlled substance use. This means if you test positive for drugs or alcohol after a workplace accident, you could lose all rights to benefits. Similarly, compensation is not payable for injuries caused by an employee’s willful intention to injure themselves or others. Insurance companies may also completely deny claims filed after you’ve been fired, laid off, or quit, viewing these late filings with extreme suspicion. Additionally, NRS 616C.232 allows denial of temporary total disability compensation if you’re discharged for misconduct, even if the misconduct is unrelated to your injury. These harsh provisions make it essential to work with a Workers Compensation Attorney who can protect your rights and challenge improper denials.
💡 Pro Tip: If your employer requires post-accident drug testing, you have the right to request a split sample for independent testing. This can protect you from false positive results that could destroy your claim.
Frequently Asked Questions
Understanding Safety Violations and Your Rights
Injured workers often have numerous questions about how safety violations affect their workers’ compensation claims. Understanding these issues before they arise can help protect your rights and ensure you receive the benefits you deserve after a workplace injury.
💡 Pro Tip: Write down all questions about your workplace injury and safety rules before meeting with an attorney. This helps ensure you get all the answers you need during your consultation.
Taking Action to Protect Your Benefits
Knowing what steps to take after a workplace injury involving potential safety violations can make the difference between receiving full benefits and facing significant reductions. Quick action and proper documentation are essential to protecting your rights.
💡 Pro Tip: Never admit to safety violations in written statements or recorded conversations with insurance adjusters. Anything you say can be used to reduce your benefits.
1. Can my Nevada Workers’ Compensation benefits really be cut by 30% for minor safety violations?
Yes, Nevada law specifically allows workers’ compensation benefits to be reduced by up to 30% for safety violations, even those that might seem minor. However, the insurance company must prove you knowingly violated a safety rule and that the violation contributed to your injury. Not every safety infraction justifies a reduction—the violation must have a clear connection to your accident.
2. What should I do if my employer didn’t provide proper safety equipment but blames me for violations?
Document everything immediately. Take photos of the work area, get written statements from coworkers about normal practices, and request copies of safety equipment purchase orders or maintenance records. Your employer can’t enforce safety rules they don’t support with proper equipment and training. This is a strong defense against benefit reductions.
3. How long do I have to appeal a workers’ comp benefit reduction in Nevada?
Nevada has strict deadlines for appealing workers’ compensation decisions. Generally, you have 70 days from receiving notice of a benefit reduction to file an appeal. Missing this deadline can permanently affect your rights. Contact a Workers Compensation Attorney immediately upon receiving any notice of benefit reduction to ensure you meet all deadlines.
4. Can I be fired for filing a workers’ comp claim if I violated safety rules?
While Nevada law protects workers from retaliation for filing legitimate workers’ compensation claims, employers may still terminate employees for serious safety violations. However, the timing of termination matters. If you’re fired immediately after filing a claim, it could be illegal retaliation. Document all communications with your employer after your injury.
5. Should I hire a Workers Compensation Attorney if my benefits are being reduced for safety violations?
Yes, especially when facing benefit reductions. Insurance companies have experienced adjusters and lawyers working to minimize your benefits. An attorney can investigate whether the alleged violation actually occurred, whether it contributed to your injury, and whether your employer shares responsibility. Most workers’ compensation attorneys work on contingency, meaning you don’t pay unless they recover additional benefits for you.
