How Work Injuries Happen in Las Vegas
Most work injuries are not random. They trace back to a condition or decision that puts workers at risk. Identifying that cause matters: under Nevada’s no-fault system you can receive workers’ compensation regardless of how the accident happened, but pinpointing the cause is also what reveals whether a third party shares the blame and owes you additional compensation.
Common causes of work injuries we see in Las Vegas include:
- Unsafe or poorly maintained premises
- Missing fall protection or absent safety equipment
- Defective tools, machinery, or equipment
- Inadequate training or supervision
- Failure to follow state or federal safety regulations
- Poorly designed or laid out workspaces
- Repetitive motion and overexertion from physical job demands
- Falling objects and improperly stored materials
- Being caught in or between heavy machinery
- Exposure to toxic chemicals, heat, or electricity
- Missing or inadequate personal protective equipment
- Workplace violence and inadequate security

When You Can Recover Beyond Workers’ Compensation
Workers’ compensation is a no-fault system, so you do not have to prove anyone was at fault to receive benefits. But comp benefits are limited: they do not pay for pain and suffering, emotional distress, or the full value of your lost earnings. When someone other than your employer caused your injury, you may be able to file a separate third-party claim and recover those additional damages. Unlike a comp claim, a third-party claim requires proving fault and causation, which is why a thorough investigation of how your injury happened is so important.
Because a third-party claim depends on fault, Nevada’s comparative negligence law also applies. If you are found partly responsible for the accident, your third-party recovery can be reduced by your share of fault, and you cannot recover at all if you are found 51 percent or more at fault. This does not affect your workers’ compensation benefits, which you can receive regardless of fault.
Accident types that often support a third-party claim include:
- Scaffold collapse caused by an outside vendor
- Forklift malfunction due to a manufacturer’s defect
- Negligent property manager at an off-site job
- Hotel contractors who fail to fix broken railings
- A delivery driver caused a collision at a loading dock
- Security contractors failing to prevent workplace violence
- Cleaning crew leaving hazards in common work areas
- Subcontractor leaving tools or materials in unsafe locations
- Elevator malfunction in a leased commercial building
- Defective power tools supplied by a third-party vendor
Parties who may share liability for a work injury include:
- Manufacturers of defective equipment or tools
- Outside contractors and subcontractors on the job site
- Property owners who failed to maintain safe conditions
- Negligent drivers in a work-related vehicle collision
- Vendors or delivery companies operating on the premises
Damages available through a third-party claim can include:
- Full lost wages and lost future earning capacity
- Pain and suffering
- Emotional distress
- Disfigurement and scarring
- Reduced quality of life
- Property damage
- Loss of consortium
In rare cases involving intentional or especially reckless conduct, Nevada courts may also award punitive damages.
Third-party claims are also subject to their own filing deadline. In most cases, Nevada law gives you two years from the date of the accident to file a personal injury lawsuit, a separate deadline from the 90-day window for filing a workers’ compensation claim.

Work Injuries in Nevada
Work injuries are common across Nevada, and they are not limited to high-risk industries.
In 2024, private employers in Nevada reported 33,800 nonfatal workplace injuries and illnesses, with more than 21,700 serious enough to require time away from work, a job transfer, or work restrictions.
That same year, 33 workers died from job-related injuries statewide, and violent acts, not heavy machinery or industrial hazards, were the single most common cause of workplace deaths in Nevada, followed by transportation incidents.
Wherever your injury falls on that spectrum, you have the right to pursue the benefits and compensation you are owed.
