Types of Serious Injuries from Escalator Accidents
Whether a person’s foot gets stuck in a step, an individual takes a tumble down them, or an arm gets crushed by the equipment, serious injuries can be life-threatening, disfiguring, and life-changing. In our experience, some of the most common serious injuries we see in escalator accidents include:
- Crushed limbs and digits
- Spinal cord injuries resulting from falls from heights
- Back injuries to muscles and tissues
- Traumatic brain injuries, including skull fractures
- Lacerations and deep wounds
- Amputations
- Scarring and disfigurements
- Loss of vision
- Emotional trauma
Escalators may not seem like dangerous weapons, but when not maintained properly, they can cause victims to suffer serious injuries and losses. As your Las Vegas personal injury lawyer, we seek out all potential losses from this accident and build a case that helps you recover any damages possible. Your outcome matters to us.
Why Escalator Accidents Happen in Las Vegas
You might not realize just how dangerous escalators can be. Escalators create 15 times more accidents resulting in injury than elevators, and most of those incidents are avoidable, according to Riding the Escalator: How Dangerous is it Really? Some of the most common reasons these accidents happen include:
- Poor maintenance: Like all working components within a business, escalators require routine inspection and maintenance to ensure they work properly.
- Malfunction of electrical systems: Though they are designed to be robust, electrical failures can happen in many of these incidents.
- Unsafe surfaces: People may tumble from escalators if the surfaces are slick or otherwise unsafe.
- Jolting movements: A person may fall if the escalator jolts suddenly, causing them to lose balance.
- Design flaws: While escalators have been around for a long time, modern systems may have flaws introduced during the manufacturing process that put others at risk when they lead to a malfunction.
- Lack of warnings: Without warning signs or instructions on potential risks, a person is more likely to suffer injury in a fall, get their foot caught, or face other risks.
Escalator injuries are not uncommon, but they can be avoided with routine maintenance, inspection, and oversight by the property owner.
Victims experiencing serious injury will find it critical to hire an attorney who can help them determine who is at fault and pursue fair compensation in that case. Our escalator accident lawyer in Las Vegas at Shook & Stone Injury Lawyers is ready to investigate your accident.
Determining Who Is at Fault in an Escalator Accident
One of the steps our Las Vegas escalator accident attorney will take is exploring all possible parties responsible for the incident.
This might include the property owner, safety and security personnel at the location, the manufacturer, or even companies repairing these systems improperly. Knowing this allows your legal team to pursue compensation against multiple parties.
How Our Escalator Accident Lawyers Help You
When you were in an escalator accident, your first step is to get medical care and report the incident to the police in cases of violence or if the property owner was negligent. You may think the process from there is as simple as filing a claim, but that rarely is what happens. When you hire our escalator accident attorney in Las Vegas, you gain an ally to help you with:
- Gather evidence. We find out why your accident happened. By looking at all the evidence available, using photos and video of the area, and even recreating the incident, we can clearly understand who is at fault.
- Build a strong claim backed by evidence. Not only do we prove fault, but we also prove all of your losses. That allows us to file a robust claim with the at-fault party and prove the value of your case.
- Negotiate on your behalf. We protect you from insurance adjuster abuse and frustrations. We negotiate a fair settlement that allows you to reclaim your life.
In most situations, this leads to a resolution through a settlement paid to you for the losses we have proven. If that does not happen, you can expect us to file a lawsuit in a court of law to recover the damages owed to you. In Nevada, you have two years from the date (NRS: Chapter 11) of the accident to take this action.
