Our experienced Las Vegas car accident lawyers at Shook & Stone could fight diligently on your behalf for any payments you may be owed while working to hold the negligent party accountable.
Proving Liability in Texting While Driving Car Collisions
Texting while driving is one of many possible negligent driving behaviors. To establish liability for an accident caused by a texting driver in Las Vegas, you need to be able to draw a direct line between the driver’s negligence and the injuries and harm you have suffered.
Any driver on the roadway has a legal duty to operate their vehicle with reasonable care. If a motorist does not uphold this legal duty—such as by taking their eyes off the road to text while behind the wheel—and they cause an accident, they could be held legally responsible if one or more people are injured and sustain losses.
A split second of a driver taking their eyes off the road can lead to a terrible and deadly collision. Rollover accidents, front- and rear-end collisions, and t-bone wrecks are commonly reported crashes that can happen when a driver texts behind the wheel. A proactive attorney could collect evidence to establish the other driver’s liability for your injuries, such as:
- Police report
- Phone records
- Eyewitness statements
- Video footage from traffic cams or nearby business
- Any other key documentation or forms of proof

Injuries & Damages in Texting While Driving Car Crash Cases
Texting while driving car wreck cases in Las Vegas can involve wide-ranging and costly personal injuries. These injuries can span soft tissue injuries, contusions, and concussions to severe brain trauma, broken bones, punctured organs, and neck and back injuries.
People involved in an auto accident need to get prompt and necessary medical treatment. Delaying treatment could not only worsen your injuries, but even hurt your case if you try to claim damages later. The insurance company might try to argue that your injuries were not as serious as they were because you did not get treatment right away.
Insurance companies are also known sometimes to try to devalue claims. Our diligent lawyers can ensure your case gets the attention it deserves while navigating case complexities like insurance negotiations or litigation (if it comes to that) on your behalf. Available damages for texting while driving car accident injuries can include lost wages, pain and suffering, medical bills, and more.
