Automobile Negligence

Though car accident cases involve claims of common law negligence, Nevada differs from other states with respect to numerous issues, including minimum coverage requirements, rights of subrogation, medical payment coverage, workers’ compensation benefits, comparative negligence, and uninsured and underinsured motorist coverage. Because of our expertise in these areas, we have successfully prosecuted hundreds of claims involving automobile negligence, and ensured that our clients have obtained maximum compensation for injuries and damages suffered as a result of another driver’s negligence.

Workers' Compensation

When a worker has been injured in an on-the-job accident or due to an occupational disease, he or she is entitled to benefits under Nevada law, including medical treatment, lost wages, compensation for a permanent or partial disability, job retraining and job placement. Our firm is skilled in this highly technical area of the law, which has become more complicated in recent years with the influx of private insurance carriers. We are able to assist injured workers from claim acceptance to claim re-opening to obtain the benefits they deserve.

Wrongful Death

Any person who wrongfully causes the death of another through malice, recklessness, or negligence may be liable to the victim’s survivors for damages. In Nevada, these actions are governed in part by specific statutes, which permit survivors or beneficiaries to recover damages for grief, loss of probable support, companionship, society, comfort, and pain and suffering or disfigurement of the victim. Our firm’s experience in handling these types of claims has allowed loved ones to heal from the tragedy, with the confidence that their claims will be pursued in a professional manner.

Products Liability

Manufacturers, distributors and product retailers may be liable to users for damages or injuries suffered because of defective conditions. These cases are often complicated, and require the assistance of experts who can identify the defect involved and testify about it at the time of trial. Shook & Stone has dedicated substantial resources to the pursuit of these complicated claims, and demonstrated the ability to obtain compensation for clients who have been seriously injured by defective products.

Social Security Disability

Definition of Disability According to the SSA: "Disability" is defined by the Social Security Administration (SSA) as a person's inability to perform any kind of work for which is is suited because of an injury or a medical condition. The disability should be expected to last for at least one year, or result in death. The disability can be a result of a physical or mental condition, or a combination of a number of such conditions.

Have you been denied Social Security Disability Income (SSDI) benefits? Contact (Link here to the contact form) us today for a free evaluation of your case.

Disabled persons or their families are eligible to collect SSDI. Once benefits begin, they will continue as long as the person remains disabled.

It sounds like a simple process, yet the SSA often denies truly disabled claimants by making the process very difficult. First, there are thousands of people who apply for SSDI each year. The lines are long and the forms are complicated. Benefits for legitimate claims are often denied—not only once, but twice and sometimes even more times. As a result, many people who apply on their own become discouraged and intimidated. So they give up when they are genuinely entitled to benefits.

That’s where an attorney experienced in Social Security Disability law is necessary. An attorney can help you get the benefits that you are entitled to in a timely manner.

Premises Liability

According to Nevada law, landowners must keep their land reasonably safe for intended users. As a result, hotels, casinos, restaurants, homeowners and other landowners or occupiers have a duty to warn of and repair dangerous conditions within a reasonable time frame. Shook & Stone’s success in pursuing these claims is based upon our commitment to performing a prompt and thorough investigation of both the premises and the specific defect to ensure that we can establish negligence.

Medical Malpractice

In Nevada, all claims involving medical malpractice are subject to review by a Medical-Dental Screening Panel before they can proceed to state court. The Panel reviews claims and determines whether there is a reasonable probability of malpractice. As members of that Panel, and experienced litigators, our attorneys are skilled in handling all types of malpractice claims, including those involving birth injuries, misdiagnosis, prescription and surgical errors, inadequate nursing care, and failure to perform appropriate follow-up.
