DePuy Hip Implant Failure

More Than 350 Lawsuits Filed in August Over Defective DePuy Hip Replacements

DePuy Orthopaedics, a Johnson & Johnson subsidiary, is receiving more and more lawsuits filed against them involving defective hip replacement devices. According to Mass Device, there were more than 350 lawsuits filed against DePuy in August, 2011. In addition, there were 700 product liability lawsuits relating to these defective implants in the past two months and 1,700 filed since January.
According to a recent Reuters news report, Johnson & Johnson could be facing billions of dollars in legal expenses and related costs with regard to these defective products. Many lawsuits allege that victims who have these defective implants in them are suffering from serious adverse effects ranging from pain, swelling and joint dislocation to nerve and heart damage.

These defective medical devices raise a number of questions about defective products and the need for proper testing. In general, medical devices are approved for sale as long as they serve their purpose. While this qualification may be adequate for most devices, products that are surgically implanted often require a higher standard. Not only are recipients of DePuy hip replacements suffering physically, but they are also facing financial burdens as a result of having to undergo additional, unnecessary surgery.

Manufacturers of defective medical devices can be held accountable for the injuries, pain and suffering and emotional trauma they cause. Patients Affected by DePuy Hip Replacement Systems Recall Aren’t Alone

It might be easy for a lot of us to forget about a recall after months have passed, but we’re not the ones who have suffered serious complications or endured the pain and burden of additional surgery to correct a problem that shouldn’t have existed in the first place.

DePuy Orthopaedics, Inc., a Johnson & Johnson company, launched a recall for ASR™ XL Acetabular Systems and DePuy ASR™ Hip Resurfacing Systems in 2010, but some patients are likely to still be paying the physical and emotional, not to mention financial, toll. The DePuy hip replacement device recall was initiated after numerous patients required a second hip replacement procedure, or revision surgery, because their hip implant failed or they experienced atypical side effects.

Data from 2010 provided by the National Joint Registry of England and Wales highlighted a five-year revision rate of about 12 percent for the ASR Hip Resurfacing System and about 13 percent for the ASR XL Acetabular System.

According to a CNNMoney article, DePuy stated back in 2010 that it planned on covering “reasonable and customary costs” of monitoring and treatment for services relating to recalled hip implants for failure and complications, including revision surgeries. With that being said, patients still don’t have a solid guarantee that they will be fully compensated for what they have had to pay for and endure.

Having hip replacement surgery in the first place is a lot to deal with, having corrective surgery after that because of poor implant design is another story.
