Las Vegas Wrongful Death Lawyer
At Shook & Stone, we understand that there are few experiences more
devastating than the loss of a family member or a loved one. While death
and the grieving process are an unfortunate part of the human experience,
the untimely passing of a person due to another party's negligence
can greatly escalate the emotional turbulence involved. If the death of
your family member or loved one was caused by a wrongful act, you may
be eligible to receive compensation by filing a wrongful death claim.

What is a wrongful death claim?
Similar to a
personal injury claim, a wrongful death claim can be filed when the death of a person
was caused directly by the negligence of another. Be it a
medical malpractice, or a situation involving
premises liability, any case involving wrongful death hinges on proving negligence beyond
a reasonable doubt. The attorneys at Shook & Stone have more than
85 years of combined experience and have helped the families of victims
receive compensation for the damages they endured.
Wrongful death claims were created to protect the rights and well-being
of a victim's family. According to the Nevada Revised Statutes §41.085,
heirs and personal representatives of the deceased may pursue legal actions
to recover compensation from the party responsible for the victim's
death. If the person who is liable for the victim's death is deceased,
then legal actions can be brought against the wrongdoer's personal
representatives or against any other parties involved.
How is compensation awarded?
During the wrongful death legal process, heirs and personal representatives
of the victim's relatives can pursue compensation in three categories:
economic compensation, non-economic compensation, and punitive damages.
As established by the NRS §41.085(a), economic compensation can include
any medical expenses the victim incurred before his or her death, as well
as funeral expenses and the lost wages and probable future financial support.
The court will also award relatives and loved ones monetary compensation
for the emotional damages they suffered. While suffering is nearly impossible
to equate in dollar amounts, monetary damage awards can help alleviate
the financial strains that a wrongful death can create for surviving relatives.
Damages can be awarded for relatives' loss of companionship, society,
comfort, and consortium; their grief or sorrow; and damages for the pain,
suffering, or disfigurement of the decedent.
Depending on the circumstances involved, punitive damages may also be
awarded to further punish gross acts of negligence and wrongdoing. The
penalties and punitive damages that a decedent would have recovered if
they had survived are awarded to heirs and family members.
While our ultimate goal at Shook & Stone is to achieve justice on behalf
of the victim's family, we are not blind to the extenuating financial
burdens that wrongful deaths can create on living relatives and loved
ones. All too often, families are forced to handle their grief and financial
worries simultaneously. The untimely death of a family's breadwinner
can eliminate their main source of income and can cause additional stress
during an already difficult time.
