Rear-End Accident

According to the National Highway Traffic Safety Administration, rear-end collisions are the most prevalent form of car accidents, accounting for nearly 30% of all auto accidents. Injuries are common in rear-end accidents, especially in cases involving high speeds, large vehicles, and truck accidents. Whiplash in rear-end accidents can cause many types of neck, back, and spine injuries, which can range in severity. There are many causes of rear-end accidents, including a lack of attention caused by distracted driving or aggressive driving practices, such as tailgating and unsafe speeds.

How are injured victims compensated?

Injured victims will be compensated for their damages after liability has been determined. In rear-end accidents, liability is frequently placed on the driver who hit the vehicle in front of his or her own car. Exceptions do exist, however, particularly in cases involving multi-vehicle accidents or other situations in which comparative fault can be shared by both drivers. In any case, injured victims who were not at fault for causing an accident can be awarded compensation in three categories: economic damages, non-economic damages, and punitive damages.

Economic Damages
Economic damages will be awarded to victims to cover the costs of any medical procedures, treatment, or care. If the injuries resulted in the victim's inability to work, compensation may also cover lost wages and potential future earnings.

Non-Economic Damages
Non-economic damages include the pain and suffering of a victim, any decrease in their quality or enjoyment of life, and any effects that the injuries may have on his or her personal and family life, such as loss of companionship and support. Non-economic damages cover primarily the emotional repercussions an injury can create and they are difficult to equate in dollar amounts.

Punitive Damages
Punitive damages may be awarded in certain cases to further punish gross acts of negligence. Cases involving drunk driving accidents or driving while texting commonly result in an award of punitive damages.
